Studio Policies, Terms & Conditions 

 

Bambu Recording Studio is a professional audio recording facility. Customer Service and satisfaction are our top priority. The following policies insure that all sessions are conducted in the most professional manner while providing our client a creative and comfortable environment.

 

DEPOSIT/REQUESTING TIME SLOT

 

A 50% deposit 14 days in advance of your session will guarantee the time slot you request. Without a deposit, if someone else wants the same time slot and offers a deposit, it will go to them. Deposits can be taken over the phone using a credit card.

 

BOOKING RATES

 

Sessions are booked at the rates published by the studio (subject to change) unless other rates have been negotiated. There is a 4 hour minimum. Time will be billed in quarter hour increments. Sessions that run longer than the original scheduled time will be booked at the published rate assuming the studio is available. Lockout sessions are based on 12- hour days. Additional time will be charged at our standard hourly rate.

 

CANCELLATION FEE

 

Cancellations after 48 hours forfeit the deposit unless we can rebook your time. You will then receive a refund of your deposit for any portion of time that we are able to rebook.

 

STUDIO TOURS

 

It is recommended that new clients tour the studio prior to their first session. During this time we can discuss the parameters of your session and make a plan to ensure everything runs smoothly.

 

START/END AND SESSION TIMES

 

The session clock begins at the scheduled time that both parties agree upon. If you arrive early and the studio can accommodate an early start, then the session clock will begin at that time. If you are late for any reason, you will be charged from the scheduled session start time, with no exceptions. Please call if you are going to be late! Set up time will be billed at regular studio rates unless other arrangements are agreed to. This includes load-in and instrument setup, microphone placement, level setting, media transfer, etc.

 

STUDIO DOWNTIME

 

Unforeseen problems can happen; If session downtime occurs at the fault of the studios equipment, that time will not be billed. The Studio's liability shall be limited strictly to the studio time of the booked session and clients agree to hold Bambu Recording Studio harmless from any damages from such downtime.

 

PAYMENT

 

You are responsible for all monies due to the studio and shall make payment to the studio with cash, credit card or previously approved check. No media will be turned over to you until full payment is made for that day. Clients will be charged a $25.00 service fee if Client’s account is not paid in full by the completion of each session. Clients will also be responsible for all legal, attorney and collection fees, if required for payment. If an account is not paid in full, immediate collection and legal action will be taken. Clients will also accrue a 1.5% interest charge per month until it is paid in full. Receipt of recording media from Studio to Client is acknowledgement between both parties that the quality of all services rendered by Bambu Recording Studio is satisfactory to Client and shall release Bambu Recording Studios from any and all liability regarding said recording media and services rendered.

 

SESSION MEDIA

 

Session media will only be released when full payment for the session is received. Once session media has been turned over to the client Bambu Recording Studio is no longer expected to maintain a backup copy of the session unless other arrangements have been made in writing. We recommend that each client make a back-up copy of the sessions immediately. Session materials left beyond 30 days due to nonpayment become the property of Clear Lake Recording Studios. Bambu Recording Studio is not responsible for any unrecoverable data.

 

LEAVING GEAR BEHIND

 

Bambu Recording Studio is not responsible for lost, damaged, or stolen gear left behind. Any property left past 30 days will become the property of Bambu Recording Studio unless other arrangements have been made.

 

STUDIO GEAR (DAMAGE)

 

In the event a piece of studio gear owned by Bambu Recording Studio or any part of its facility becomes damaged by you, or anyone in your party, due to negligence, accident, or willful act, you agree to provide monetary compensation in the amount of full replacement value of the damaged item. Damage to the studio property of any kind that are a result of anyone in client's party or group will be assessed to client's account.

 

STUDIO RULES

  • No smoking in studio. Smoking is permitted in the front patio.

  • Food and drink is encouraged to be consumed in the lounge and patio area. Food and drink may be brought into

    the studio but must be kept away from equipment racks, and the recording console.

  • Please place your unwanted trash in receptacles provided.

  • No firearms allowed on the premises.

  • It is recommended that only individuals essential to the recording be present during the booked time.

  • Illegal drugs are strictly prohibited and we reserve the right to refuse service or cancel a session if a client

    appears to be under the influence

 

 

RESPONSIBILITY

 

The person responsible for paying for studio time must sign an agreement and will be held responsible for the actions of all artists and guests he or she brings to any session. These rules apply to all persons. There are absolutely no exceptions whatsoever. This ensures a healthy business relationship for you as a recording artist and for the studio as well.

The client affirms that he/she is the rightful owner or assignee of material to be recorded or reproduced. Clear Lake Recording Studios & our employees are not responsible for copyright violations, talent or creative royalties, mechanical reproduction licenses, or any other liabilities for such material. Client also agrees to indemnify Clear Lake Recording Studios and its employees for any and all claims, costs, losses, detriments and expenses of any kind or nature. Including, without limitation, attorney’s fees and cost incurred by Clear Lake Recording Studios by reason of any breach or alleged breach of any representation, warranty, or agreement made by client.

 

STUDIO DISCLAIMER

 

Prior to any session work beginning, the client agrees to furnish a written signed copy of the above Studio Policies as a formal agreement and obligation to make payments and adhere to all other policy requirements as stated herein.

 

 

                      Privacy Policy

 

To demonstrate our commitment to the privacy of your personal information, we have developed this privacy policy (“Policy”), which discloses our privacy practices for the information we collect at our web site at www.BambuSound.com (or any successor web site(s) thereto) (the “Web Site”). This Policy informs you about:

 

1) What personal information we collect;
2) Information from other sources;
3) Who collects the information;
4) How we use your personal information or disclose it to third parties;
5) What choices you have regarding collection, use and distribution of your personal information;
6) How to correct, update or delete your personal information;
7) What kind of security procedures we use to protect the loss, misuse or alteration of information under our control; and
8) How this policy may be amended.

 

“Personal information” is information that would allow someone to identify or contact you, including, for example, your full name, telephone number or email address. Personal information does not include aggregated information that, by itself, does not permit the identification of individuals.

 

Acceptance. By using the Web Site and/or the Services offered by Bambu (“Services”), you agree to be bound by the terms and conditions of this Policy, which Policy is also incorporated by reference into, and subject to, the terms of our Terms of Use. If you do not agree with the terms and conditions of this Policy, do not use the Web Site and/or register to use the Services as a customer or professional of Bambu Recording Studio (“Customer” or “Professional”, respectively).

 

(1) What Information Is Collected


Users may browse through the informational portion of our Web Site without providing us with any personal information. However, if you choose to become a Customer or Professional (if applicable) and/or to submit any materials for review through the Services, we will ask for your contact information, which may include, without limitation, your name, age, gender, city, state, country, email address, a profile picture or avatar, details of your other websites and social media profiles, including links to those websites and profiles.

We also may collect personal information from you when you send us emails or submit other forms of information directly to us and collect personal information from you at other points on our Web Site that state that personal information is being collected.

 

(2) Information from Other Sources


Bambu Recording Studio allows you to sign up and log in using your Facebook account. If you sign up using Facebook, Facebook will ask your permission to share certain information from your Facebook account with Bambu Recording Studio. This includes your basic info (Name, Profile Picture, Gender, User ID, Networks, List of Friends, and any other information you made public), and your email address.

 

This information is collected by Facebook and is provided to us under the terms of Facebook’s privacy policy. You can control the information that we receive from Facebook using the privacy settings in your Facebook account.

If you sign up to Bambu Recording Studio using Facebook, your Bambu Recording Studio account will be connected to your Facebook account, and you will have the ability to share your Bambu Recording Studio activity with Facebook and it will be published in your Facebook friends’ news feeds.  This is not done automatically and you have the choice to share or not share your Bambu Recording Studio activity on Facebook.

 

Bambu Recording Studio also allows you to sign up and log in using your Twitter account.  If you sign up using Twitter, Twitter will ask your permission to share certain information and abilities from your Twitter account with Bambu Recording Studio.  This includes your name and email address, the ability to read Tweets from your timeline, see who you follow, and follow new people, update your profile, and post Tweets for you.

 

This information is collected by Twitter and is provided to us under the terms of Twitter’s privacy policy.

If you sign up to Bambu Recording Studio using Twitter, your Bambu Recording Studio account will be connected to your Twitter account, and you will have the ability to share your Bambu Recording Studio activity with Twitter and it will be published in your Twitter status updates.  This is not done automatically and you have the choice to share or not share your Bambu Recording Studio activity on Twitter.

 

(3) Who Collects Your Information


Bambu Recording Studio owns and operates the Web Site and owns and maintains the personal information collected through the Web Site. Our mailing address is 938 B Street, Hayward, CA 94541 and our email address for privacy concerns or questions is austin@bambusound.com.

 

(4) How We Use Your Information or Disclose It to Third Parties


We may provide certain of your personal information to third-party mail houses to fulfill e-mail blasts of information or electronic newsletters related to membership or Bambu Recording Studio to our Customers. In connection with the delivery of our Services, we may share the personal information with third-party partners or vendors who help deliver or administer the Services, or with those whom we partner in connection with business ventures related to our Services, but they are only permitted to use the information in connection with the delivery or administration of our Services, or with offers to purchase related products and/or Services.. For example, we will not share your credit card information with a third-party credit card processing company. While we believe that the personal information that we share with our third-party partners (other than our payment processor(s)) will result in opportunities that may be of interest to you, you have the right to tell us not to provide this information to such third parties by either e-mailing us at the e-mail address provided in (2) above, or by sending your written request to:

We may share, sell or transfer the personal information you provide to us in the event of bankruptcy or the sale or transfer of substantially all of our corporate assets or capital stock.

 

Please note that if you provide any information on your own or directly to third parties who provide services to, or connected with, our Web Site, different rules may apply to their use or disclosure of your personal information. We encourage you to investigate and ask questions of these third parties before disclosing information to them, as Bambu Recording Studio shall have no responsibility or liability for their use or disclosure of your information.

 

Although your privacy is very important to us, due to the existing legal regulatory and security environment, we cannot fully ensure that your personal information will not be disclosed to additional third parties. For example, we may be forced or compelled to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, in the unlikely event that either we or a government entity need to investigate or resolve possible problems or inquiries, we can (and you authorize us to do so) disclose any information about you to private entities, law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate.

 

(5) Choices Regarding the Controlling the Collection, Use and Distribution of Your Information


If you do not want us to use your personal information for the purposes specified in this policy or the purpose stated at the time of your submission of such information, please do not become a Customer or Professional of Bambu Recording Studio or submit personal information to us.

 

(6) Correcting, Updating and Deleting Your Personal Information


You can access and update your personal information by contacting Bambu Recording Studio at austin@BambuSound.com or calling Bambu Recording Studio Support at (408) 425-7012. Bambu Recording Studio also may make such functions available through the Web Site. 

 

If you are a Customer and wish to delete your personal information, please contact Bambu Recording Studio at austin@BambuSound.com to request deactivation of your membership and termination of your status as a Bambu Studio Customer. If you delete such information, it cannot be used by us or disclosed to third parties in the future. However, even if you delete or change some personal information in our registration database, it may still be stored on other databases (including those kept for archival purposes). Also, because we need to have certain of your personal information in order to deliver our Services, you will not be able to receive such Services if you delete such personal information.

 

 

(7) Our Security Procedures


We have established and maintain reasonable security procedures to protect the confidentiality, security and integrity of your personal information. We collect personal information only from our Customers and Professionals. We implement significant off-line efforts to further protect this information, including limiting employee access to personal information and updating our employees regarding our security practices and privacy policies. However, please recognize that “perfect security” does not exist on the Internet, and Bambu Recording Studio cannot and does not guarantee the absolute security of your personal information.

 

(8) Changes to this Policy


Bambu Recording Studio may amend or change this Policy at any time. We will post any revisions to this policy on the Web Site, so that Web Site users (i.e., Customers and Professionals) are aware of these changes. Any User who provides additional personal information after these changes are posted will be deemed to have accepted the revised privacy policy. If at any point we decide to use personal information in a manner different from that stated at the time it was collected, we will send such person an email notifying him/her of such changes and giving him/her the option as to whether to allow us to use their information in this different way. Without such consent, we will use personal information in accordance with the privacy policy under which it was collected.
